IMPORTANT: Please read these Official Contest Rules (the “Agreement”; the “Terms and Conditions”) carefully before participating in Natchez Trace Compact’s Text Campaign Promotion.
No purchase necessary to enter or win. This Agreement explains the Terms and Conditions that govern the Promotion. It is your responsibility to ensure that you have read and understand them. By receiving any prize, reward or benefit in connection to the Promotion, you agree to be bound by the respective Terms and Conditions of the Promotion. Participating in this promotion and the prizes that are offered to members and non-members is at the sole discretion of the Natchez Trace Compact, and the Natchez Trace Compact has the right to change respective Promotion Terms and Conditions, in whole or in part, or to discontinue the Promotion, at any time with or without notice to its members or non-members.
How to Enter:
From your smart phone, text “RIDENTP” to 95577. When prompted, enter your email address. Upon entering your email address you are entered into the giveaway.
Promotion Period and Winner: The promotion begins March 15, 2018 and ends at 7:00 p.m. April 30, 2018. One (1) winner will be randomly chosen on May 5, 2018 and notified via email. The winner must respond to the email within 48 hours. If the winner(s) does not respond, they forfeit the giveaway prize and a runner-up will be chosen.
Prize: One (1) participant will be chosen at random to win a 6 night/7 day Natchez Trace Parkway (TN, AL, MS) getaway with 1 room overnight accommodations in the sponsoring destinations (total 6 nights), 2 meals per day (restaurants determined by the destination sponsor) and attraction passes for winner and a guest, $200 in Harley-Davidson dealership store merchandise and a $150 gas card.
Participating destination sponsors: Franklin, TN, Florence, AL, Tupelo, MS, Jackson, MS and Natchez, MS. Itinerary and dates of trip to be coordinated with the Natchez Trace Compact.
Eligibility:
Only one entry per participant will be allowed/included. Each participant must be 21 years of age or older for entry in the Promotion. Users have to provide the Natchez Trace Compact with their e-mail address. Participants must agree to take a photo on their journey to the Natchez Trace Compact marketing Facebook page to confirm validity of the contest. By entering this contest, you may be enrolled to receive future information from the Natchez Trace Compact marketing programs. You may optout at any time.
Each person must have a valid mobile phone number and email address to be eligible.
Message and data rates apply. The Natchez Trace Compact is not responsible for any fees incurred by the user. The Natchez Trace Compact is not responsible for your inability to connect to the Internet. Users must be human beings: no machines, scripts, or automatic services may be used to accumulate discounts. The Natchez Trace Compact cannot anticipate the number of participants for any promotion. All content is subject to approval and may be altered by the Natchez Trace Compact if necessary.
The following individuals are not eligible participate to receive rewards of this promotion: 1) Employees, officers, and directors of members of the Natchez Trace Compact, their sponsors, affiliates, subsidiaries, advertising, promotion, fulfillment agencies, legal advisors, their immediate family members and persons living in their same household; 2) any person under the age of 18; 3) any person who is not a U.S. citizen or lawful permanent U.S. resident.
Ongoing contests or discounts: The Natchez Trace Compact may hold other promotions for the duration of this Promotion.
By participating in any Natchez Trace Compact promotion, you agree to the unlimited use of your name, voice, or likeness for the purpose of advertising, trade, or promotion without further compensation. The Natchez Trace Compact agrees that your name, voice, and likeness shall not be used by the Natchez Trace Compact in any libelous or slanderous manner or be sold to any third party. You are aware that the Natchez Trace Compact does not have control of the BFAC.com platform and cannot prevent third parties from obtaining and using any materials submitted to the Natchez Trace Compact through the BFAC.com platform. You understand that the Natchez Trace Compact is not responsible for third party use of any information submitted by you to BFAC.com. The Natchez Trace Compact is not responsible for security of personal information that is submitted over the Internet using a third party vendor (BFAC.com).
Limitation of Warranty:
THE PROMOTION IS BEING PROVIDED TO MEMBERS AND NON-MEMBERS “AS IS” WITH NO EXPRESS OR IMPLIED WARRANTY OR CONDITION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDGELAND TOURISM COMMISSION EXCLUDES ALL CONDITIONS, REPRESENTATIONS, WARRANTIES AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED INTO OR INCORPORATED INTO THIS AGREEMENT, WHETHER BY STATUE, COMMON LAW OR OTHERWISE, WITH RESPECT TO THE PROGRAM, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND TERMS AS TO MERCHANTABILITY, SATISFACTORY QUALITY AND FITNESS FOR ANY PARTICULAR PURPOSE AND IMPLIED WARRANTIES AND TERMS ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
THE NATCHEZ TRACE COMPACT DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE QUALITY OF, OR ACCURACY OF ADVERTISEMENTS FOR, ANY MERCHANDISE, PRODUCTS, OR SERVICES OFFERED OR PROVIDED BY OFFER PARTNERS OR SUPPLIERS IN CONJUNCTION WITH THE PROMOTION.
YOU ACKNOWLEDGE THAT YOU HAVE NOT RELIED UPON ANY REPRESENTATION, WARRANTY OR OTHER ASSURANCE GIVEN OR MADE BY OR ON BEHALF OF THE NATCHEZ TRACE COMPACT PRIOR TO THIS AGREEMENT AND YOU WAIVE ALL REMEDIES WHICH, BUT FOR THIS DOCUMENT, MIGHT OTHERWISE BE AVAILABLE TO YOU IN RESPECT OF SUCH REPRESENTATION, WARRANTY OR OTHER ASSURANCE.
Termination or Changes:
The Natchez Trace Compact reserves the right to terminate the Promotion at any time without notice to the extent permissible by law. The Natchez Trace Compact may modify the Terms and Conditions from time to time, to the extent permissible by law, with or without notice, and continued participation in the Promotion after such modification shall be deemed to be acceptance of any such modification. It is your responsibility to check the Terms and Conditions that can be found at the Natchez Trace Compact application. If you do not agree to any modification of this Agreement, you must immediately cease participation in the Promotion.
Fraud; Termination of Eligibility Status
Participation in the Promotion is subject to the Promotion Terms and Conditions. Any failure to comply with the Promotion Terms and Conditions, any fraud or abuse, even if due to mere negligence, relating to the awarding of prizes, or any misrepresentation of any information furnished to the Natchez Trace Compact by you, or anyone acting on your behalf, may result in the termination of your eligibility for and/or participation in the Promotion and the forfeiture and/or return of any prizes awarded connection with the Promotion. In the event of fraud, misconduct, or suspected fraud or misconduct by you or anyone acting on your behalf, the Natchez Trace Compact reserves the right to suspend prize delivery in connection with the Promotion indefinitely pending investigation.
Disputes / Errors:
All questions or disputes regarding the Promotion, including without limitation, questions or disputes regarding eligibility for the Promotion, or the eligibility to win a prize must be submitted in writing by June 1, 2018 to _____________________________________.
Natchez Trace Compact shall resolve any such disputes at the sole discretion of the Natchez Trace Compact. In the event that the Natchez Trace Compact makes an error, such error shall not constitute a breach of this Agreement.
Miscellaneous:
Trip must be taken by December 30, 2018.
You understand that the Natchez Trace Compact uses this platform for providing information and managing promotions. The Natchez Trace Compact retains the right to make any changes to its texting and mobile application accounts and its contest rules to remain in compliance with rules, policies, and terms of service. Such changes may be made without notice and at the Natchez Trace Compact’s sole discretion. You understand that nothing herein grants you any rights to any software or materials that are part of the platform or any other third party platform.
You agree that any cause of action relating in any way to any Natchez Trace Compact contest, or relating in any way to these contest rules must be brought in a court of appropriate jurisdiction in the State of Mississippi.
